Foggers FDA Status Table: What Each Record Says About Foger
| Question | Short answer | Source | Checked |
|---|---|---|---|
| Are foggers FDA approved? | The FDA does not "approve" vapes. It reviews premarket tobacco product applications (PMTAs). Foger has submitted PMTA applications, and its devices are waiting on FDA review. | FDA PMTA process; manufacturer filing | 2026-10-31 |
| Is that unusual for a disposable? | No. Most disposable brands on the US market are in the same position: applications filed, review still open. | FDA, Tobacco Products Marketing Orders page | 2026-10-31 |
| Where are foggers made? | We could not confirm the factory from a public record we could open. Read the country of manufacture printed on the box. | Product packaging | 2026-10-31 |
| Are foggers discontinued? | We still sell five products from the brand: the Switch Pro 30K kit, its 5% and 0% replacement pods, a spare Switch Pro battery, and the Bit 35K. | Our store listings | 2026-10-31 |
| Are foggers banned in Texas? | Texas SB 2024 took effect Sept 1, 2025. It bars selling e-cigarette products made wholly or partly in China or another listed foreign-adversary country, or marketed that way. | Texas Legislature Online; Texas Comptroller FAQ | 2026-10-31 |
| Do states keep vape product lists? | Several states run vapor product directories. Virginia's Attorney General keeps one under Va. Code § 59.1-293.15. | Code of Virginia | 2026-10-31 |
This table is the short version. Each row is explained below, with a link to the page we read. We are a retailer, not a law firm, and nothing here is legal advice. Federal and state vape rules change often, so treat the dates in the last column as the point when each answer was true, and check the source again before you rely on it.
Two facts matter most for anyone asking "are foggers FDA approved". First, the FDA does not approve any vape, Foger or otherwise; it reviews applications and issues marketing orders. Second, Foger has filed PMTA applications, and like most disposable brands its devices are in the review queue. Everything else on this page follows from those two points.
What an FDA Marketing Order Means, and Where Foger's PMTA Stands
Under federal law, a new tobacco product, which includes a nicotine vape, needs a written marketing order from the FDA before it can be legally sold in the US. The usual route is a premarket tobacco product application (PMTA). The FDA's Tobacco Products Marketing Orders page (content current as of October 30, 2026) says new products without that order cannot be legally introduced into interstate commerce, and that their sale is subject to enforcement.
The same page explains why "FDA approved" is the wrong phrase. The "safe and effective" standard used for medicines does not apply to tobacco products. The FDA instead decides whether a product is appropriate for the protection of public health. A marketing order lets a product be sold. It is not a finding that the product is safe.
Where does the Foger PMTA stand?
Foger has submitted PMTA applications for its devices, and those applications are waiting on an FDA decision. That is the same position most disposable brands sold in the US are in today. FDA review of vape applications takes a long time, and so far marketing orders have gone to a small number of products, mostly tobacco- and menthol-flavored pods. You can search every order the FDA has issued in its Searchable Tobacco Products Database.
So the accurate way to describe a fogger is "PMTA submitted, under FDA review", not "FDA approved". That applies to the Switch Pro 30K system and the Bit 35K alike. If a seller tells you a fogger is "FDA approved", that wording is wrong for any vape, because the FDA does not use it.
Where Are Foggers Made? Reading the Country on a Foger Box
We wanted to give you a sourced answer here and could not. We did not find a public record we could open and read that names the factory or the country where these devices are built. Some websites state that Foger is a Chinese brand, but we couldn't check those claims against a primary source, so we are not repeating them as fact.
What you can check yourself is the box. US packaging for imported goods normally carries a country-of-origin line, often on the bottom or back panel near the nicotine warning. Look there for "Made in…" or "Manufactured in…" before you buy, especially if you live in a state that restricts vapes by country of manufacture.
Are foggers made in the USA?
We have no evidence that any of these devices is made in the United States, and we would not claim it. If the question matters to you, the printed country of manufacture on your box is the answer to rely on. That line also matters for the Texas law covered further down this page.
Are Foggers Discontinued or Being Discontinued?
Foggers are not discontinued in our store. As of today we sell three main models: the Switch Pro 30K kit at $22.99, replacement foger pods at $16.99, and the Bit 35K at $21.99. Live stock is shown on each product page and in the table below.

| Flavors | 20 of 65 flavors in stock | 69 of 92 flavors in stock | Restocking | 14 of 30 flavors in stock |
Rumors that foggers are "being discontinued" tend to start when one store runs out, when a flavor is renamed, or when a state law takes a brand off local shelves. None of those means the manufacturer has stopped making the product, and we don't speculate about the brand's plans. If a flavor is out of stock with us, it shows as out of stock on the page rather than disappearing. Right now 20 of 65 kit flavors and 14 of 30 Bit 35K flavors are in stock.
We also sell 0% nicotine foggers pods for the Switch Pro power bank, and a spare foggers battery for the same system, a 1200 mAh base sold without a pod. New parts being listed is the opposite of a range that is ending. For the full picture of the Foger vapes we carry, start at the homepage.
Are Foggers Banned? State Vape Directories and Local Rules
There is no single nationwide ban that names foggers. What exists is a patchwork. At the federal level, the premarket review rules described above apply to every vape sold in the US. On top of that, states and some cities pass their own rules, which can include:
- Flavor restrictions that limit or bar the sale of flavored vapes.
- Vapor product directories, where only products listed by the state can be sold there.
- Rules on where a product was made, such as the Texas law below.
- Licensing, tax and delivery rules for online sellers.
Directories are the newest of these. Virginia is one example. Under Va. Code § 59.1-293.15, the Attorney General keeps a public directory of liquid nicotine and nicotine vapor products whose manufacturers have filed certification forms. Other states have passed or proposed similar lists, and each runs its own version. A product can be sold in one state and be off the list in the next.
Because these rules change, we don't publish a state-by-state list of where foggers are allowed. Our checkout checks the shipping address before payment, and our shipping policy explains what happens if an address can't be served. For buying in person, the guide to buying foggers locally covers what shops tend to stock. Please check your own state and city law. This is not legal advice.
Are Foggers Vapes Banned in Texas? What SB 2024 Covers
Texas Senate Bill 2024 was signed on June 20, 2025 and took effect on September 1, 2025, according to the bill history on Texas Legislature Online. Its caption: "Relating to a prohibition on marketing, advertising, offering for sale, or selling certain e-cigarette products."
The Texas Comptroller's e-cigarette FAQ explains how the state reads the law. In summary:
- It is illegal in Texas to market, advertise, sell or offer for sale an e-cigarette product that is wholly or partially manufactured in China or another foreign adversary of the United States, or that is marketed as made there.
- The foreign-adversary list the FAQ cites (as of April 1, 2026) is China, Cuba, Iran, North Korea and Russia.
- "Manufacturing" includes blending, mixing, filling the device and packaging.
- If the country-of-origin label names one of those countries, the Comptroller presumes the product was made there, and it can't be sold.
- The presumption can be rebutted only if the packaging plainly states the product was blended, poured and packaged outside those countries. A line such as "Made in Compliance with SB 2024" is not enough on its own.
- The Comptroller says there was no grace period after September 1, 2025.
So, are foggers banned in Texas? It depends on what the box says. A fogger whose label names China as the country of manufacture falls inside the Comptroller's presumption. That is why the country line on the packaging, covered above, matters more than any rumor. Texas readers should check the Comptroller's page for current guidance before buying.
Fake Foggers: How to Check a Fogger Is Genuine
Counterfeit vapes copy the look of popular brands, and foggers are no exception. You can't confirm a device just by its name, but a few checks against the spec sheet catch most copies:
| Check | Switch Pro 30K pod | Bit 35K |
|---|---|---|
| E-liquid on the box | 15 mL | 21 mL |
| Coil | 1.0Ω dual mesh | 0.8Ω dual mesh |
| Puff rating | 30,000 Normal / 18,000 Boost | 35,000 Normal / 25,000 Boost |
| Nicotine | 5% (50 mg/mL) salt nicotine | 5% (50 mg/mL) salt nicotine |
| Screen | OLED on the power bank: battery, puffs, mode | 360° curved OLED; Bitcoin icon on Boost |
| Fit | Snaps onto the Switch Pro power bank only | One piece, nothing to attach |
Beyond the specs, look for clean, even printing and spelling on the box, a batch number or scratch code that matches the device inside, a nicotine warning statement, and flavor names that appear on the brand's real lists. Our foggers flavors list shows every flavor name we carry. A price far below other sellers is a warning sign, as is a pod that wobbles or won't seat on the power bank.
If you aren't sure how a genuine unit should behave out of the box, the guide on how do foggers work walks through the pod, the screen and Boost mode.
Are Foggers Safe? What the Label and the FDA Say
We can't tell you a fogger is safe, and no seller should. Here is what the records say. Every device we sell except the 0% pod contains 5% (50 mg/mL) salt nicotine, and nicotine is an addictive chemical; the box carries that warning. The FDA states, on its list of e-cigarettes with marketing orders, that even those products are not safe and that all tobacco products are harmful and potentially addictive. Foger's own applications are still under FDA review.
For what is inside a fogger, including the nicotine strength by device and whether there is any THC (there isn't), see nicotine in foggers. Vapes are for adults 21 and over only. Federal law set that minimum age in December 2019, and every order here goes through age verification before it ships.
If you are comparing one of these devices with other brands, our page on foggers alternatives lines up specs side by side. The regulatory status of most of those brands is checked the same way: search the FDA tobacco products database by name.
Foggers FDA and Legal Status FAQ
Are foggers FDA approved?
The FDA does not approve vapes. It reviews premarket tobacco product applications (PMTAs) and issues marketing orders. Foger has submitted PMTA applications, and its devices are waiting on FDA review, the same as most disposable brands sold in the US. Any seller calling a fogger "FDA approved" is using the wrong term.
Where are foggers made?
We could not confirm the factory or country from a public record we could read, so we won't guess. Check the country-of-manufacture line printed on your Foger box, usually on the back or bottom panel. That label is also what Texas uses when it applies its 2025 law on vapes made in China and other listed countries.
Are foggers being discontinued?
Not in our store. We currently sell the Switch Pro 30K kit, its replacement pod and the Bit 35K, with live stock on each product page. Out-of-stock flavors stay listed and are marked as such. We don't have any notice from the manufacturer about ending the range, and we don't speculate about it.
Are foggers vapes banned in Texas?
Texas SB 2024, in effect since September 1, 2025, bars selling e-cigarette products made wholly or partly in China or another listed foreign-adversary country, or marketed that way. The Comptroller presumes a product was made where its origin label says. Check your box and the Texas Comptroller's current guidance. This is not legal advice.
How can I tell if my foggers are fake?
Compare the box and device with the spec sheet: 15 mL and a 1.0Ω coil for a Switch Pro pod, 21 mL and 0.8Ω for the Bit 35K, 5% nicotine on both. Look for clean printing, a matching batch code, a nicotine warning and real flavor names. A very low price or a pod that won't seat is a red flag.
Are foggers safe?
No seller can honestly call a vape safe. Every device we sell except the 0% pod contains 5% salt nicotine, which is addictive. The FDA says even vapes with marketing orders are not safe and that all tobacco products are harmful. Foger's PMTA applications are still under FDA review. Vapes are for adults 21 and over only.
